Parliamentary Elections in Moldova - possible fraud

On the 5th of April 2009, there took place the Parliamentary Elections. Everyone was waiting for this and hoping that it will bring a change, that it will be the last day of Communist Party in Republic of Moldova. Everyone knows the unlawful things they do and that they just don't care about the country and the people.

But still there is a big percent of badly informed people that as a result voted for communists. And what we have know is that the Communist Party has obtained 49,95% of the votes.
There are other 3 Liberal Parties that also will be the part of the parliament.
Partidul Liberal - 12.79%
Partidul Liberal Democrat- 12.26%
Alianta Moldova Noastra - 9.81%

So a big part of the population, especially the civil society from Chisinau is very disappointed. This is definitely something unexpected and they want to do something. It is hard to say now what exactly, but it can be the non- recognition of the Elections for example. It's a pity that the international arena said the elections in Moldova were very fair and legal, so there is no reason for raising any problems for them.

This was a protest organized by young people from Moldova. The information was spread on Curaj.net, Unimedia.md, Facebook and other websites. There were also members of the opposition who participated in this protest, such like Vlad Filat, Dorin Chirtoaca, Leonid Bujor, Stefan Uritu. These are those that I saw personally, there were also a lot of other members of the different parties and its great that they came out in the streets with us.

Communists didn't say a word about this)) They didn't even show it in the news)

Police against the Liberal Party

I have no words to explain my feelings about the police officers in Moldova. Could someone please come and take them out of the country ???? It is impossible to support it anymore.
If you are not a part of the communist party than you are already in trouble.

Anything you want to do will have no result. Even organizing a public action, having all the documents doesn't guarantee you the protection against THE POLICE OFFICERS.

Even being the mayor of Chisinau doesn't change the situation. The police is saying that the mayor gives illegal orders, that he is DISTURBING THE PUBLIC ORDER with his actions :)))) and all he did was the attempt to raise the problem that Russia breaks the sovereignty of Moldova by maintaining its troupes on our territory.

Another interesting thing happened the same day in Balti. There was taking place a peaceful protest action of the liberal party. Couple of young people were standing, and than there came a lot of "young comsomolists" and violently attacked the people from Liberal Party. They were beating them and took all their posters. AND WHAT DID THE POLICE DO THIS TIME??? They just left!

So weren't the comsomolists "disturbing the public order" ?))))) whats wrong with them?? can't they just once make it clear when is it disturbing the public order??>...

But anyway, my opinion is that they should be ashamed of themselves. And one day they will get what they diserve...

Moldova 1 - national television

This channel - Moldova1 is totally under the authority of the Communist Party. They have been always providing news only about the president Voronin, about the prime-minister, about how things are going well.
But they never mention the real facts that Moldova is in such a crap. That about 1/3 of the population left the country. That the prices are getting higher. That there are some serious abuses of human rights every day and nothing changes. People can't start their own business. The taxes are very high and don't stimulate the economical development. blablabla
More than that, when you watch some news on ProTv for example, and than you check the same news on Moldova1 or NIT, and in the first case on ProTV they show the real bad thing about Moldova, and in the other two cases they say that everything is fine, under control, and developing :)) that makes me laugh histerycally!!!

Law on non-discrimination

This weekend, on the 3rd of October, there took place a protest action in front of the Parliament of Moldova. It was organized by some non governmental religious organizations.

Their main protest is for excluding the words "sexual orientation" from the law on non-discrimination, so that they could continue their discrimination.

When you look at those people, you may think they are crazy. Because they act as if they were not so sane, I may say. They are so aggressive and violent. The main arguments that they provide is that this law will impose their children to go to homosexual seminars at school (!!!), this will affect the traditional families and will be a propaganda of homosexuals, and there will be more and more people with a different sexual orientation.

This is so stupid. These people don't even know what is to be a homosexual, if they sustain the things above.

Just one question for all you homophobic people - can you be transformed from a straight person to a homosexual one by propaganda, if you were born straight??? how can that be possible??))) this is so funny. You have to be really DUMB to affirm that.

They also say that there were no homosexuals before - again stupid!)) There were always homosexuals, always!) You just don't know about it.

I feel sorry for this stupid, retarded people, that want to get involved in someones life, and impose you their own visions. Get a life...

Compensations for Downwinders

Have you ever heard of downwinders? These are the people that had to suffer the negative effects of radiation from some nuclear testings. This cases are always very difficult and so serious, because it is being violated the right to health of people. They suffer from the illegal nuclear testings which take place near the place they live.
People start to have serious health problems which appear in couple of years. Most often its cancer which is lethal on a certain stage if not treated. That is why there is a huge need of attorneys which can correctly protect the rights a legal interests of these downwinders.

Teacher's Strike

Teachers from all the parts of Moldova are having a strike for already 4 days. But noone really talked officially to them yet. The action takes place in front of the Government building. but it seems like noone cares.
The minimum salary of a teacher is something about 60-70$. Which is not normal at all. There are just couple of thousands of those poor teachers and they cannot assure them a normal salary???
The government sustains that the money were spend for the people that suffered from the overflowed Nistru this summer. But this is not really true, according to some political parties, they sustain that the money for the people were obtained from legal persons from donations.
So were is the money for the teachers???

REFORMS: Recycling

This will be a new compartment in my blog. I am going to write about the reforms that I would do if I was a legislator or something...)
There are so many thing that need to be changed in this society, but nobody actually does anything.
So my first reform is about waste processing. Last year there appeared special grids for plastic bottles. I thought that was very smart to do. People through their bottles there.
Besides that I think there should be created for special cans for glass. When you want to throw something from glass why not in a special can? It can be easily recycled.
We also don't have any factories for recycling tyres, old equipment, used machine oil. There are no things like that and people just throw them away.
It would be great to spend couple of millions of lei and built one, two factories for recycling.
Because remember that thing "the government always has the money, it just doesn't want to spend it on you"

Who is to blame for Osetia war? Georgia vs Russia

Who is responsible for the Osetia war? Who should be treated as a criminal and who should be blamed for everything?

My own vision is not what everyone tells on TV. I was watching both Russian News and European.

Russians sustained that Georgia sent their armed forces over civils, and the only solution was to respond to that. As long as Russia keeps its "peaceful forces" on a territory it has the right to do that. Ok, Russia sustains that Georgian forces were just killing common people from the start, and what Russia was "obliged" to do is just stop the intervention and save the people.

Russian news were saying that there were killed over 2000 citizens by the Georgian forces, and the European news were talking only about 200 killed by accident.

In my opinion Saakashvili did one thing wrong, he made the first noticeable step - introduced the forces. But I remember that Russia was provoking it for about two months for sure. Russia was easily sending airplanes through the territory of Georgia with no permission. There were several unpleasant provoking situations. Which was normal to wait for a response from a country which is actively sustained by USA.

I am not saying that Saakashvili did the right thing. I agree that there died a lot of people which is bad and may be considered as genocide. But I don't want to analyze the whole situation from that point of view as Russians do. They try to take your attention from the global aspect of the problem.

Russia always had imperialistic views on everything, every weak country which is nearby. What Russian did for the last 18 years in both Osetia and Transnistria was violating the sovereignty of Georgia and Moldova. As a proof to that is the thing that Russia was always against the replacement of its peace keeping forces, with the peace keeping forcing offered by UN.

The both wars in these regions in early 90's wouldn't simply take place. The tanks would move to the main town, take the parliament, arrest the criminals and that's it. Normally those that would try to opposite to that would be killed. There wouldn't be so many people killed. Russia was never fighting for saving the lives of common people, or for independence of those territories, because that way they would not need Russia's help anymore. Russia always wanted to keep its influence in those territories by maintaining the armed forces.

So the same thing would happen in Osetia too, if Russia would say "ok guys, this is your territory, and we agree with you, just take it, we are leaving". There would be no war. Georgians would simply arrest the separatist government of Osetia and reestablish the sovereignty of their country.

I say Russia is to blame, if judging from the perspective of all those years, of everything they did, of their politic in general. Russia is the one who started the cold war II.

Best time for a vacation for a President?

Everyone knows - Moldova is in a very difficult, I may say critical situation at the moment. Both biggest rivers of Moldova, from both sides, Nistru and Prut are are overflown by water. This situation was created due to Carpatian rains. Ukraine and Romania are also affected by it.
Hundreds of people were evacuated, and a lot of houses were destroyed.
On national television they keep saying "everything is under control". That is just funny. How can it be under control if they cannot stop the water??? One or two dams were broken through. How can it be under control? Thousands of people don't have a place were to sleep. Everything they gathered for their entire life was destroyed. And I am not really sure that they are going to receive serious compensations.
The Government said they are going to receive new apartments depending on how many members of the family they have. Are you kidding me? You don't have enough brain to build a normal dam and protect your own citizens, and now all you can do is offer them a two room apartment???
Zinaida Grecanii - the prime minister - went out couple of times to see the people herself. She was looking really funny, near those poor destroyed people.
By the way the President didn't even do that. Now he went on a vacation in Croatia. To visit his friend the President of Croatia. They are going to spend a week on a luxiurious yacht.
What can I say ... Bravo!!

Transnistria and Moldova - united?

There are weird things happening these days. Some people expect changes and the solving of the Transnistrien problem, but the problem is lasting for so long, that it is hard to believe now that everything is going to be fine, and finally Transnistria will belong to Republic of Moldova again.
So, from the moment when the communist party came to ruling of the country, it was in 2001, they didn't really try at least to make things better between the two banks of the river. More than that, those relationships were absolutely destroyed, in that way, that Moldova had put different economical interdictions on Tiraspol, no officials from Moldova were allowed on the territory of Transnistria, there were no discussions between the two parties on the problem, for the whole period. So the relations were getting worse and worse, till the beginning of this 2008 year. When suddenly the communists remind themselves that it is in fact the last year of their "ruling", and the polls actually say that they loose a lot of their positions like from 45% to 20% and it is getting worse and worse. So Vladimir Voronin, the president of Moldova, went to Russian Federation couple of times this year. Some of these meeting were official, some non-official.
Suddenly Vladimir Voronin started talking about this unification, about the magic way he is going to do this in just couple of months, before the elections of the Parliament in 2009 in fact. Couple of weeks ago they met with Smirnov, the president of non-recognized Transnistrien Moldavian Republic. They met and firstly had a short talk in front of the cameras, and than went in another room and talked privately for two hours. I wonder what they talked about all that time? Maybe discussing some secret plan...) I would like to add, that the meeting was like a spontaneos one, other political parties were not even informed about it. How can a president make such important decisions by himself in a parliamentary republic?
Ok, what Transnitria proposed is not just absurd, the document is humiliating Republic of Moldova. Some of the points of it are like recognizing the administrative frontiers, keeping the custom posts, recognizing the history of Transnistria, and the thing that it never was a part of Moldova, having an important part of votes to make decisions by themselves, keep the military forces of the third part(!!!!). This is insane! People! It was proposed for signing, otherwise Voronin is settled free...
Well he commented it like a very important meeting, like "finally, respect for Smirnoff" bla bla bla...
What is interesting in this whole situation is that couple of days I saw a communistic program, with this communistic supporter number one Constantin Starish, he was having a conversation with our president, and he just dropped the words like "i was not going to meet with Smirnoff, in fact, I never had such a desire to see his face, the initiative came from Vladimir Putin, he told us to meet and talk" - hey, how can a president talk like that? I don't understand, he is representing the whole country, the interests of each citizen, who cares over he likes to talk to Smirnoff or not, if they get along or not? He has to solve the problem!!! Wake Up!

Compensation in Moldova and in USA and Personal Injury Lawyer

I was reading about the criminal punishment in common law, and found a nice classification which would probably serve as a good example for legislation of Moldova too. One type of punishment is the compensation which is divided into three types:
Fine – which exists also in Moldova, this is when you have to pay a tax for what you did.
Community service – also in Moldova, 50 conventional units for 1 month imprisonment.
Compensation of damages to the victim – this is not settled in the legislation, in the Criminal Code of Moldova. And is remaining at the desire of the judge to settle a compensation of damages. Usually this compensation is too small, because Moldova is not used to compensations yet.
People when go to court they don’t usually aspire to a compensation, they whish to get some right, something which was violated, and they don’t dream for any compensation of 1 million dollars like in United States of America.
At the same time lawyers from America do their best to obtain this compensation; either it is a car accident injury, or personal injury claim. I know a case when a young man in Moldova was beaten by 5 people, and he stayed in the hospital for a month and obtained a compensation of 300$. What kind of lawyers did he have? A personal injury lawyer should be a professional. He should not let such situations happen.
So the difference between compensation punishment in Moldova and USA is a huge one. Here if a person gets injured he is not sure he will get any moral or physical damage compensation.

Signs

I have noticed that Americans had spread he idea of having signs everywhere. This is typical for any type of institution. They like to put signs next to their entrance, in order to let the people know about their place of location. In Moldova this is not popular, probably because the tradition is different.
The same thing is about american people. They like to have signs on their yards. Whether they sell the house or anything else, or just making an advertisement. This can be a yard sign, or a political opinion sign. Can you see the difference between the elections in United States and in Moldova. In United States they have a lot of signs during elections, with different colors. people accept caring a special sign with them during the whole election process.
I guess people in Moldova don't have such a habbit of expressing their thoughts by such signs, like yard signs, elections signs, political signs
But maybe that could be a good idea when you have to promote something, some idea. And i wonder why the political deputies don't use this good way of promoting their campaigns, because that is a good way of attracting the people.

Mortgage in Moldova (credit ipotecar)

Mortgage would be a credit guaranteed by some immovable property, but which stays in the possession of the debtor. The mortgage credit can be offered by banks, financial institutions and other creditors.

Due to the development of the market economy in the Republic of Moldova, the system if mortgage credits appeared and started its development.
The creditors, governmental functionaries, building companies and banks are very optimistic about the future of mortgages in Moldova. At the end of the year 2006, 13% of the total credits offered were for mortgage, but in 2005 it was only 3-4%, which shows a great development. A lot of companies had made some researches and came to the conclusion that 60% of potential buyers of property need a mortgage.
In the Republic of Moldova the mortgage is usually taken for 10 years, sometimes 15, the interest rate is between 12-16 %. Which comparing to the market in United States of America, were the interest rate is from 4-7%, I may say that Moldova has to work a lot to allow such low rates. That is why there is a small number of people which can allow themselves to take a mortgage in Moldova. Nowadays the people are not well informed about their rights and obligations regarding their property, and especially about the mortgage possibility and its risks.
It is considered that the development of the mortgage system was possible due to the lack of concrete normative acts which could regulate it not only in general but also individual situations. But the Government had made some efforts and adopted some norms which could help this situation, such as: the registration of immovable goods, the execution of mortgage rights mortgaging of immovable property basing on accordance of some guarantees. (there are also some other legal acts such as Legea cu privire la gaj, Legea cadastrului bunurilor imobile, Codul civil, Codul de procedură civilă, Codul de executare)

When a person wants to buy an apartment in a building which is not ready yet, in order to pay less, he has to pay a certain sum of money or even the entire sum. Not many people can afford that, so they prefer to take a mortgage. But mortgage is being offered only for an apartment registered in the cadastral register, which is not possible for an unfinished apartment. The builder is at the same time asking for a “acceptance to invest” from the customer and he invests the money in the future apartment. Because of poor legislation, not long ago the initial investors, building companies, had the possibility to sell the apartments to several people, through this “acceptance to invest”, because it is not registered yet in state cadastral register.
The mortgage in Moldova, represents a problem at the moment, because it is not well regulated by the legislation. And there should be adopted more laws which could help this situation. The government should have the possibility to keep under control or at least be informed about the real situation on the market, about the companies and banks the offer mortgage programs, and exempt the costumers from potential frauds. Nowadays a small percent of people know about mortgage possibility, and it is not very popular among people, because it is something new for Moldova and also because of high interest rates.
But the main problem is that the salaries in Moldova are really small, and officially less than couple percent of total population can afford mortgage. But in USA almost every working person can afford taking a mortgage.
So in Moldova it is almost impossible to pay a mortgage for common people.

Moldova vs. European Court for Human Rights

These days our shame was made on public - Moldova is no more at the 2nd place at ECHR (after Russian Federation). Now she is nr 1. Congratulations!!! I guess Mr President for sure thinks they are not right and don't judge us obviously, but who cares...
The latest case won is Balan vs Moldova. This man won 5 000 euros for moral and material damages and 2 000 more for expenses. The case was about his photo of the Soroca castle. The moldavian authorities used this picture on the local id cards (buletin). And when he asked a recompense for that or at least concluding a contract with him, they refused, considering that they are entitled to use anything they want. This guy went to the court of human rights and he won.
This is not just and abuse from the public authorities, this is a national shame, they were using his picture on thousands of id cards, and didn't even ask him. And it is strange that no other court in Moldova recognized his rights.

As the situation with the Presidential elections is getting more tensioned each day, both sides are trying to find new mechanisms and methods of obtaining more votes. These days I found a website which was exactly about that. It is about different democratic candidates, such as Promote Hillary Clinton, or Barack Obama. Americans have this really powerful tradition to support their candidate till the end. They believe and trust him, and do their best to promote their favorites. On that website, about Promote Hillary Clinton, they offer different useful stuff for their supporters, such things like t-shirts with the pictures of democrats, pens, vote cards, sticky notes, and address labels. Logically all these items contain the emblem of the Democratic Party. The people which support the democrats can by these stuff and use it for promoting their party. This is such a culture to have all this stuff, as it represents a way of expressing your opinion, your political views. This is a way to be free, to fight for your beliefs. That is how you decide the future of your own country and your family. This is how you can stand for your rights, your opinion, protect your ideas and values. In Moldova we don’t really have much of that stuff, and it’s a pity that the political spirit is not so healthy and strong as it is in the United States.

As history was my favorite class at high school, it became very useful for me nowadays. Knowing history offers a person huge chances of understanding many things in his daily life, not only things about himself, but understanding processes that happen all around the world.

Many events that happen today, that we see on television, are something very familiar. For example some political reforms, or changes in some government, this is what was happening for a long time. HISTORY IN THE NEWS is everywhere. Just try to pay attention and see how a company is developing for example, being a small one from the beginning it starts to use some principles and methods which other companies used in past. This is how history helps a small company to develop. Or when you are watching “the primaries” in the news, you see how democrats fight the republicans. And you understand that this is a historical battle which lasts for a long period of time. This is HISTORY IN THE NEWS. As more you find out about such stuff, as the more intelligent you become. Knowing history is really helpful. All the political and economical processes are basing on some theoretical data which you can learn only from history.

The modification of the costumer protection law.

The law on protection of costumer rights was initially adopted in 1993, than modified in 2003. The latest modification took place on the 8th of December 2007.
This modification was stimulated by certain reasons and possible situations, but in my opinion it is not relevant for Moldova. In many countries, where the protection of costumer rights has an old tradition, the Government has to front the problem of the abuse of good faith principle, from the side of costumers. For example in United States, they had to do something with the situation when a person was buying a certain product, uses it for a while and than returns it back to the shop, because it didn't fit his purpose. For example, you buy a dress for a wedding, which costs a lot of money, but you know that you are going to wear it only once, after the wedding you can return it back and motivate it that you have changed your mind. This is what a lot of people were doing for some years, and the shops didn't have any mechanisms which could protect them from that. The law offers a priority to the costumer, the 14 days, in which you can return the product with almost no motivation.
But in Moldova it is different. People are not really used to bring things back, and if they do that, the companies don't really execute their duties. From a 100 of cases, only 10% probably will be satisfied. I heard a lot of situations when people were buying low quality products, or which were breaking in the first days and they couldn't get any compensations from sellers. It's a pity, but they don't respect the laws in Moldova.
Now the modification of the law I think was added with a lot of abusive clauses. They had introduced a list of products which can't be exchanged for another one, if you don't like it. This list contains almost all kinds of products.
People in Moldova were not abusing their right of 14 days, the principle of good faith. Most of them don't even know about their rights, about the Association for Protecting the Costumer's rights

Selling public enterprises of Moldova

The minister of economy, Igor Dodon, made today a declaration about some huge, i would say enormous changes in the economy of Republic of Moldova. Starting from the 16th of November, on the local exchange sales are going to be sold the stocks of 83 state enterprises. Starting from 0,01% of stocks and till 100% of stocks. The ministry of economy is planning to sell the stocks in a week. This was probably the weirdest part of the news.

Anyway this decision was taking due to the influence of external experts and analytics, most of European Community. Because the situation with monopolization is really acute in Moldova, they were obliged to make such a reform. There is introduced a new law, which gave the possibility to the Government to sell some enterprises. There is also another law on the state enterprises which cannot be sold, there is a list of 300 enterprises, such as Termocom.

The problem is that why do they have to sell the stocks of all the state enterprises in such a short time? And why did they announce it only some days before the sales? It is not enough time for other investors, especially abroad, to analyze, to get to know the Moldovan market and enterprise itself. Some analytics consider that this was made intentionally in order to allow the local and previously informed investors to buy the enterprises, and create in such a way an unfair competition.

In general this is a healthy decision. Which was suggested by a lot of international bodies. In fact, as usual the procedure, the moldovan way of concluding affairs and organizing things in business and government is a typical one, and characteristic for this region. But I hope it will not ruin this wise initiative this time, but I'm not sure about it.

United States Of Moldova

I went to Otaci these days. We had some things to do there. This trip really shocked me a lot, and I found out many scary things about the Republic of Moldova.

Well, Otaci is a lost town, as most of the location from Moldova. The distance from Chisinau is about 250 km, this means we drove 500 km that day :)). The population of Otaci is about 8 000 people. It is a small town, but very beautiful, located on the bank of the river Nistru. On the other bank of the river is situated the Ukrainian city Mogilev - Podolsk. It is bigger than Otaci, much bigger. It is better developed. The difference can be seen by their custom points. The Otaci custom wasn't repaired for many many years. In the market days, when people circulate from one side to another, the custom works really slow, and it takes a lot of time for the people.

But let's get back to the population. Starting from the beginning of this year, 2 000 of people left from Otaci to another places, even out board, for work. These are the official numbers given by the officials from Otaci. Besides this fact, there is another one thing. Officially the half of the population consists of gypsies. But the deputy mayor says that it may be even more, about 70 %. They are very hard in keeping some order. Even though they are not creating problems, but anyway. Their kids go to school, but only for the 4 first years of studying. The are 8 gypsy clans in Otaci. Each having their own occupation and leaders. Most of their relatives work abroad. In Russia, for example. They sell goods in the markets, steal, sell drugs, traffic people and many more. Maybe some of the have legal activities, but these activities are very not popular among gypsies. But anyway, let's get back to Otaci. Talking to the deputy mayor, I found out that there is one of the clans which is reacher than the rest and more influencing. On the latest mayor elections they were preparing the gypsy candidate - the most important baron. But something changed in their plans and they didn't do it. But the deputy mayor says "if they did, we would definitely loose these elections, the baron just said that it is not the time, and that we, the common people are just not ready for this, but someday ...".
But lets imagine that this really happens. I think it will change many principles and views in general. After the winning of gypsies in Otaci, the gypsies from Soroca will desire the same. Moldova - Bulgaria, and how they treat moldavians

Let me tell a horrible story about how Moldavians are treated at the custom of Bulgaria.
The problem started once with the joining of European Comunnity of Bulgaria and Romania. Everyone knows how hard it is now to get a visa to both countries. Even though, many citizens of Moldova have strong relations with both of these countries, this fact didn't motivate their Governments to create an easier way to enter their countries.
Let me start with Romania. One year ago, they were saying "we are going to join EU, but that doesn't mean that we will forget about the citizens of Moldova, our neighbors. We are planning to create an easier system of visas(comparing to other countries), which will be a free one, and come to Romania whenever he wants." In reality what happens now: people are disabled in getting a visa, because-
1. visas are given only to groups of not less than 5 people.
2. you have to wait a huge, enormous line until you will get in front of the counsel.
3. many people speculate on this thing, and promise to easier this procedure for some remuneration, like at least 50 $.
This problem could have a solution, when the two presidents of both countries had a meeting in spring. They were promising to fix the problem, to open another two counsels in other regions of Moldova, in order to easier the procedure of visa getting. Normally this didn't happen, as usual actually. Yesterday took place an interactive, live show, with Ms President Vladimir Voronin. When he was asked about this fact, he said "i didn't promise to anyone, we said we are going to see what it is about this problem, no one promised to solve anything". This is what a president should say? That he can't do anything, and he didn't promise anything?
Whatever he says.... poor people, the only thing is the poor people that he is lying to...

But let's talk about Bulgaria. Also needs a visa. There are three ways to get to Bulgaria.
- through Romania, this procedure needs a visa for Romania too. which is a very hard way, and not everyone wants to follow it.
- by plain to Bulgaria from Chisinau.
- with a vapor from Odessa, directly to Bulgaria.

Don't know about flying to Bulgaria, but I found out some really curious facts about the "sea way" to Bulgaria. Listen up to me. Some of my acquaintance chose to go this way. They didn't want to have problems with the Romanian embassy. When they got to the Bulgarian port, they were very strictly checked by the custom officers. Very strictly means - awful. Each bag, all the clothes checked. The cell phones - checked. If someone had number of his relatives from from Italy, for example, than that meant for the custom officers he could be a "potential illegal migrant" and they were immediately sending him back home. All the people were checked by a doctor in order in order to find "drugs inside them" (sorry don't know how to describe it). It was a obligatory for all!!! And this doctor didn't have the necessary single usage gloves. She was saying "i'm washing my hands after each person and that is enough". And if anyone says something, he is being sent back to Moldova, with not explanation and no money returnee. The Moldavian agencies also don't give money back.

Isn't such a strict control violating the human rights? Shouldn't they have special permission for medical control? I'm sure they are violating the law there.

There is another aspect. If you have a Romanian visa and go transit through Romania to Bulgaria, than the custom officers don't ask you a thing. Probably this could be motivated by the reason that if the people succeeded i getting both visas, spent more time, more money, than probably this can mean they are better than those that wanted make everything easier. I mixed everything) whatever, I don't know what the motivation is. And their behavior is illegal and stupid. There is something to think about at least for the international organizations, of course if the president doesn't care.

A weekend in Transnistria, pt 1...

It seems like Transnistrian situation is getting worse every day. Normally the reason of it is their own actions.
Probably one of the wrongest thing is their self-invented legislative system, which activates on "their" territory, which at the same time is still the territory of Republic of Moldova. This fact, elementary, is violating the Constitution of RM and I'm really confused by the fact that the heads of the state don't really try to do anything.
Let's try to analyze some of the elements, which are very ridiculously orientated against the population of the Republic of Moldova.
I made a visit last weekend to Transnisria, stayed at some friends and was really shocked. I never stayed there for more than an hour, but this time had to stay longer. The custom officers really discriminate the people with the citizenship of RM, and offer priorities to Ukranians, Russian and those from Transnistria. Citizens from RM have to make a temporary registration at the custom territory, even if they are going transit through Transnistria, which is very stupid. In Moscow, for example, you have to make a registration if you stay more than 3 days. But we don't compare Russia and Transnistria.
The question is "why on Earth, the citizens of RM are imposed to make a registration on the territory of their country?" And you know, their motivation is that this way they want to control us, in order to prevent unsanctioned military actions or any movements. But this is stupid. If Moldova has the plan to attack Transnistria no registration of people will stop that.
This registration is just the act of stupidity of their own, just to show what they can do, even if can do nothing.
Another thing is that people have to pay 6.90 lei per each registration. And once again I wonder why? If you pay for something, you should get an argument. The registration represents a small sheet of paper, very tiny. Than what for do we have to pay? What kind of service is that? Who gets this money and why? Or it's just an ordinary source of income for Transnistria? I guess this is it.

Ecological catastrophe at Nistru river, Soroca, mda

It is actually not a sudden thing that happened now. This situation was formed more years ago, and no one cares. The thing is that the town Soroca, situated at the north-eastern part of Moldova, is dropping out a lot of wastages and sewerage waste. The smell is awful. I stood in Soroca for two days, and had a walk over those dirty places. The thing is that all the citizens from Moldova drink water from Nistru river. But how can people be sure of the water they drink if it so polluted and the public administration doesn't care, because it happens for many years. There is also a factory situated more northerly, in Otaci, which started to top off waste. This provoked a huge growth of algae. I took some pictures of all of those sceneries.
PS at the latest elections for local public administration won the national-liberal party. i hope they will do something with that disgusting situation.

Dorin Chirtoaca won the second tour of elections for the post of mayor. The second tour took place yesterday, the 17-th of June. And the results of the elections were told after midnight.

here they are:

Dorin Chirtoaca, Liberal Party - 61,17 %
Veaceslav Iordan, Communist Party - 38,83 %

this is an amazing result and it represents a very important change in the public administration of Chisinau. Even though there were many spiculations and anti-propaganda against Dorin Chirtoaca (like saying he is a very radical nationalist) people trusthim more than his oponent. It is believed that it was made the first step for the change of the today political regim. And it will deffinetly influence the parliamentary elections in 2009.

Dorin Chirtoaca is only 28 years old, but he's got the neccessary education and represents the prototype of a modern moldavian politic.

For the last months, the mass-media was filled with all sort of news. It seems like the battle of the candidates for mayor is a very important one, it involves many political parties and interests. And they try to do the best, sometimes even illegal things in order to compromise the other candidates. The following text represents sequences which I found on this topic.

The independent candidates from the Municipal Council of Chisinau, consider that their rights for the performing of the electory campaign are being violated. For exemple there are too little places for publishing the advertisments. Also the procedure of organising meetings with the population is very complicated. You have to waite for a positive answer. The number of candidates is big, so this creates a complicated situation.

Director SRL TVR-Extern Yuri Timofte said that the "public media- Moldova - 1 and Radio-Moldova ignore independent candidates, and don't invite them to the electoral debate."

Another conflict appeared on te 31 of may. INFOTAG says that they have received a shoking news. The Agency received a message by e-mail on the letterhead of a color logo Liberal Party, email-chirtoaca.dorin @ yahoo.com. But later, Dorin Chirtoaca denied this fact, saying that it is a lie.

MoldovaNoastră Alliance (AMN) believes that the authorities are preparing a massive falsification of ballots from the guest that on the day of local elections on June 3 will be located outside the country.

INFOTAG: AMN are informed by the foreign observers that the " communist agents are gethering on the border databases on Moldovan citizens abroad. " "We are warning the observers of dangers of the data through the use of scanned original signature of the Ministry of Information Development for vote fraud and misappropriation of Communists at least 600 thousand votes citizens abroad," notes the treatment of AMN.

600 thousands of votes represent about 25 % of the total number of the votes.

The Coalition-2007 had discovered facts of intervention of priests in the process pre company. Church officials from Causheni and Drasliceni were agitating for certain candidates. Mayor elections in Chisinau 3 -rd of June 2007

The Mayor elections left a negative character since the last time. There were three attempts of choosing a mayor, but with no luck. The main reason was that people were just ignoring the elections and the presence was less than 30 % in the first tour, and less than 20% in the following two.
I think this can be explained by the fact that people are not feeling confident for their government. There was no person for a candidate which could serve as a strong and sure personality. The candidates just couldn't receive the trust of the citizens.

Here are the results of the elections from the 10-th of July 2005, in Chisinau.

the total number of participants in the elections was 156617 people from Chisinau, which represents less than 20 % of the population of this city.

This was a total fail for the mayor elections. But anyway there had to be a person who could serve as a mayor, even temporary. The person selected was Vasile Ursu, the representative of the communist party (seems to be logically the fact that he was choosen). He used to be the executive of duties of mayor for almost 2 years. Couple of months ago he was given the duty of the minister of transportation in the Republic of Moldova. His place was taken by Veaceslav Iordan (also the representative of the Communist Party).

Now the candidates for the new elections a getting ready for the new "fight". This will solve the problem, wether the communist will take the lead in the mayor's person, or will try to fight till the next parliamental elections. Will they get the one or the another one...

How to create an NGO in Moldova!

The Law of the Republic of Moldova on public associations. Nr.837 from 17.05.96

I will start with a definition of a public association (this is the notion given for the NGO’s in the legal acts of the Republic of Moldova). A public association is a voluntary system, independent, self-controlled, made up due to the free manifestation of the will of the associate citizens, basing on their collective interests. The aim of a public association is to serve the social interests, civil rights, economical, social and cultural, which doesn’t have the goal to get economical profit.

Public associations represent community movements, peaceful organizations which protect the human rights, women organizations, veterans’ organizations, for kids, for youth, scientifically, cultural, sportive organizations etc.

An NGO can be started at the will of at least three people. This means that an NGO should have at least 3 members/citizens or more juridical persons. Foreign citizens can fond or can be a member of an NGO on the same basis as the citizens of the Republic of Moldova, but they can’t be chairpersons of public association, or members of control and auditing bodies. Also not less than a half of the members of a foundation council must be citizens of Moldova.

In the article 5 (1) of LPA, associations can be founded in one of the following organizational-legal forms:

Public movement (association of natural and/or legal persons (public associations only) that do not have a fixed membership);

Public organization (membership association of natural and/or legal persons (public associations only), based on a fix membership, founded for the common activity in order to achieve the objectives and goals of the Statute, as well as the protection of their common interests);

Public institution (union of citizens without fixed membership, created to perform certain services, works in the interests of its participants and in order to achieve the Statute goals).

There is also another distinction - the existence of associations and foundations pursuing activities of public benefit and the ones pursuing mutual benefit.

In order to be registered and organization must have the following documents: an application, signed by all members of a managing body together with their place of residence; two copies of statute; two copies of a protocol of a founding convention (conference) or general meeting, which approved a statute of a public association.(A protocol shall contain information on establishing a public association, on approval of its statute, on election of directing and control/auditing bodies); information about founders of a public association: for natural entities - family name, first name, year of birth, place of residence, citizenship (to be attested by their signatures); for a public association - a copy of certificate of state registration of a statute of this association, an extract from a protocol of a meeting of an authorized directing body of a public association with a decision to establish a new public association, and a copy of founding agreement in case of establishing a public institution or a union (association) of public associations; a statement of a citizen, or in case he is dead - a statement of his relatives on an agreement to use a personal name of the citizen in a name of a public association; a decision of a supreme body of a public association on vesting a directing or executive body with right to represent the association in a process of registration; a document, confirming the location of a public association; a bank document, confirming a payment of a registration fee. After the presentation of all of these documents the organization is being registered. They also receive the necessary documentation, certificates which can prove their legality.

From this moment the organization has the right to start its activity on legal basis. A public association can have its productive-economic and other entrepreneur activity exclusively for the realization of objectives and goals specified in its Statute.

An NGO can possess any patrimony (enterprises, institutions, buildings etc.) that it needs for its activity, besides the one which can belong only to the state.

Also there are several conditions that an organization should meet:

organizational and legal form of the association;
name of the association;
legal address of the association and territory, within the limits of which it executes its activity;
goals and objectives of the associations, methods of achieving them; a period, for which the public association is to be established;
terms and procedures of enrolment into membership of the association and leaving it (upon fixed membership);
rights and duties of the public association members (if a fixed membership takes place);
structure of the public association, a procedure of its founding; exact names, structures, competence and terms of powers of governing, executive and control/auditing bodies of the association, their place of location;
procedure of statute approval and making amendments;
sources, procedure of formation and usage of property and other assets; membership fees amount (if a fixed membership takes place); a body, competent to make decisions on procurement, distribution and disposal of property;
procedure and terms of convocations of general meetings, conferences, congresses;
forms of participation of the public association in affairs of society and state;
procedure of formation, status, structure and methods of activity of primary organizations of the public associations;
main parameters of financial report and a way of its publications;
Procedure of reorganization and termination of activity of the public association.

About the taxation - public associations and foundations are not entitled to VAT privileges. There are some exceptions like intergovernmental agreements. Public associations are exempted from custom duties and other taxes concerning the export-import operations which come through intergovernmental agreements of technical assistance (this specifically refers to World Bank, TACIS, and USAID). Still they have to pay taxes. But there some exceptions - Ministry of Finance recognize as being eligible for income tax exemptions only public benefit associations and foundations. But the organization has to meet some conditions: they have to prove that represent a non-commercial organization and also that the property of the organization is not distributed between the members; the entire income from the bylaws activity is spend to pursue bylaw goals; the property or the income shouldn’t be used in the favor of the member or founder; shouldn’t support any political party. Also there is created a special list of the NGO’s which don’t have to pay taxes. They can receive donations and grants for the realization of their purposes.

This is the modality of forming and creating an NGO. It is not an uneasy one but only that way the state can control an organization. Because of the fact that the Republic of Moldova needs a huge number of NGO’s which will help its development, many people are acting with bad faith. Some people try to take advantage of the NGO’s and uses the funds of it in their own purposes, or don’t pay the taxes and escape from the legal responsibility.

Medical Assurance in the Republic of Moldova

The law on Obligatory Medical Assurance for the year 2006 was elaborated in 1998, it was the law nr 1585 – Xlll on 27 February 1998. The Government decided the following:

- it will be applied the unique program of medical assurance starting from the 2006.

- The program will be released according to the limits of the prescribed funds.

- The Company of National Medical Assurance will make contracts with the formations which offer such services and activate according to the existing legislation. And together with the local administrative authorities will make the project popular for the population.

- The minister of health and social protection will supervise the releasing of this program for the 2006 year.

The law was approved by the decision of the Government nr 1360 on December 22-nd 2005.

In general, taking seriously, medical assurance is a great thing, because it helps anytime you need it and normally you don’t have to pay extra money, because you pay your insurance monthly. That represents an easy system, which has to be efficient for both parts.

In most of the countries the systems works great, because it had some kind of basis. Because the people are used to respect their obligations.

But, introducing such a program in Moldova is uneasy. First of all because the funds of it were not enough even for the first year of its activation. That is why the following situation happened in Moldova – people were coming to the hospital, holding the polis in their hands and the doctors couldn’t help them, because their financial recourses were ended. They couldn’t give the necessary medicines to the population, just because of the fact that they didn’t have any. People were going to the Drugstores and buying the medicines themselves. It seems like the money they got from the people for the insurances were not enough for the hospitals and doctors. Also another ugly fact is that people in Moldova are used to pay the doctors themselves. Doesn’t matter what he did but it is used that he should receive a remuneration for his work. And 99% of the people were doing that and after receiving the medical insurance, they were still remunerating the doctors. So, what is the reason of a medical insurance if you still have to pay some extra money (officially of nor officially)? Also many people held the opinion that when a doctors sees that you have an insurance (which means that he won’t receive the money directly), than he treats you like an animal. He just makes everything possible to get rid of you, he doesn’t care because he’s not interested anymore. That is why people still pay them directly.

Once with the appearing of the medical insurance, all the medical services became very expensive. That is why staying without insurance is very uncomfortable.

However there are a lot of misunderstandings with this program, it is a positive factor for the country. There is just a need of some specialist who could elaborate a good, efficient system, basing on other’s countries exemple.

The situation of the Patent holders in Moldova

As it is known that there is a legal project on the patent reform. Actually the government wants to completely modify this whole system.

First of all I will start with a brief history. The patents on the legal activity of enterprises were introduced in 2001. Nobody liked the idea, I mean the common people. Because they had to pay a certain tax and from that time everybody which was selling anything, had to procure this patent, this right to sell goods and pay a tax. The patents had put the small businessmen under a certain control. So generally saying this had a good impact. Anyway the common people will never understand laws, even the good ones.

So after several years, they now elaborates a new project, a new reform, regarding this problem, which consists in the fact that every enterprise will have to register his own firm, to hire several workers and also to have a cash register. This is in a simple explanation. This means that there will be only huge companies or whatever huge stores, and there won’t be people that will be able to sell something by themselves in the markets.

This decision seems to be not a logical one, because in such a poor country, like Moldova is, it would be stupid to invent such stuff, and not to let common people do what they can in order to survive. When they can’t find a well-paid job, then they try to do something by themselves.

Many people are sellers on the central market, which is a huge one, and creates an ugly aspect for the city. But they have nothing to do with that, because they don’t have any other sources of existence.

The government motivates this reform by the fact that it is being hard to control all those small patent holders. Also they are being hiding their profit from the state and pay a smaller tax. But this is because the tax is really huge for such a poor state (over 20 percent, + more). How can somebody develop his activity in such conditions?

They suppose that the situation will be the following – more people will unite in an enterprise and that will make their activity more transparent for the state.

So, this situation created many debates in Chisinau. Also on the 2 of February took place a meeting in front of the local mayoralty. But that didn’t give any effect. The law will be approved anyway.

The main participants will be the wine producers and the exporters of wine. These are the people that created the “Expovin Moldova” exhibition, in order to settle new relations with their potential clients and partners. The modification of Custom Code

It was adopted on 20.07.2000, but it was published in the Official Monitory only in 01.01.2007, in a special edition. It was adopted by the Parliament. This code settles the juridical, economical and organizational principles, of the custom activity and is orientated to the protect the sovereignity and the economical security of the Republic of Moldova.

The legalization of prostitution is in discussion now. This may reveal a lot of people and places which are doing this, and will put them under control. As it is known Moldova is one of the countries, which server as source for human trafficking. Moldova occupies the third place.

The legalization could solve many problems: the control of infections, the control of profit etc.

Prostitutes are often beaten and there is nobody that can help them. But with the legalization they will be under protection, and their rights will be guaranteed. Also this will bring considerable sum of money for the budget of the Republic of Moldova.

Now there a lot of debates concerning this problem, but it will be solved soon.

The mayor wants to sell Chisinau to the international investors!

There was elaborated a General Plan of reconstructing the Chisinau City, by several institutes of projecting from Chisinau and by Business Consulting Institute (BCI), also specialists from Romania and Belarus.

The Plan was presented on the 10-th of January, and it will be publicly debated within two months. The citizens will be able to give advice and to express their feelings according to this plan. But I, personally, don’t really understand how they are going to select the people, and in which way they are going to share their thoughts with the governors. It’s impossible, because they don’t have the needed knowledge, such as economists, jurists, and politics and so on. So, this leads me to the idea that it’s just a fake presentation, and the opinions of the common people won’t be taken into consideration. It’s just for the people, to make them think that they count.

Actually I don’t think that they need this reconstructing plan of the capitol of Moldova.

For example one of the points of it is moving the citizens from the center of the city, to its boarders. This is insane. How can they make someone change it’s place, it’s illegal.

The General Plan (ГенПлан), is really huge and has to be read very attentively.

The mayor also mentioned that they should let the investors invest in Chisinau. This phrase became very usual for our public authorities. The investing of international investors, means developing in a way, but it also represents the money which will permanently leave Moldova. Chisinau will become the source of cheap profit for the international huge companies. And the governors, as usual mask it as a benefit.

Visa for Romania!

Since the beginning of the year 2007, Romania has joined the European community. Great for them, but it creates a lot of difficulties for the citizens of the Republic of Moldova.

Besides the fact that now the frontiers of the European Community are as close as it can be we are situated in a certain blockade now. So we should get in, or we will suffer a lot from it. We don’t want to be outside.

But anyway, the direct problem now represents the visas that every person from Moldova, which wants to go to Romania, has to get. This procedure takes a while. At the beginning of the 2006 the Romanians prevented us about the introducing of the visas system. And they sustained that it will be an easy procedure for the citizens of Moldova. Anyway, the Embassy of Romania is crowded by huge lines of people, waiting for their visa. The embassy can’t do all the necessary work in a short time. And not everyone can get visa as quick as needed. The embassy of the Romania asked to be offered the right to open some more offices in order to perform they job. This action is supervised now, but in order to open some more consulates, it takes a couple of years. So I don’t think that the procedure of getting a visa to Romania is an easiest one, it creates a lot of problems, minuses for the citizens of the Republic of Moldova.

US Constitutional Law verses Moldavian Constitutional law

I had to prepare an essay on this theme. So here it is.

I was thinking about the main differences of the Moldavian legislation and the American one, about the mechanisms that rule these countries, about the historical evolution and so on. So, I just found some differences which can explain the position of Moldova, and its internal processes.

First of all, these legislations can’t be compared, because of the lack of democratically history and basis, in the legislation of the Republic of Moldova. Also the corruption represents a distinguished element of the bad developed countries (this element slows down the development, political, economical, juridical…). In the United States, people are afraid to take bribes. But in Moldova, every public functionary doesn’t move without taking bribes. They are not interested in detecting the corruption. Even the professors and teachers, are got used to take bribes. And a considerable percent of them intentionally try to make the students to give the bribes.

Another negative side of Moldavian government is the Transdiestrian problem. The United States doesn’t have such a problem. There exists a certain order. And I don’t think that someday a state would like to get separated.

There’s another difference of the Parliaments. The United States have only to parties: the Republican Party and the Democratic Party, which actually have almost the same political orientation. In Moldova, the Parliament consists of a lot of parties, and each of them wants to lead in his own way, which will serve their own purposes. The two partied Parliament in the United States creates certain equilibrium in the government of the country.

I would also like to comment the elective systems. It’s from the Al Gore verses Bush case. I don’t consider the American elective system efficient and objective. And, in my opinion, thousands of votes are not taking into consideration in such a way. And probably Gore would win, if the votes were counted all together.

“She alleges that Ferguson persuaded her to leave her desk and to visit the Governor in a business suite at the hotel, where he made “abhorrent” sexual advances that she vehemently rejected.”- This situation, for example, even if could happen in Moldova, no one would ever find out about it. The president would do everything possible to keep this woman silent. This woman wouldn’t be brave enough to go the police officer, and accuse the president. I have never heard about cases of sexual harassment in our country. Even though I’m sure they happened anyway. It’s just that the notion of “sexual harassment” is a sort of a new one, for European and American society, but not in Moldova. Women are afraid to declare it, because they think it’s a shame. They just don’t want to fight for their rights.

I’ve chosen this case, because I wanted to show the differences of the responsibilities, of duties and their place in the governing of the country of the American president at that moment, and the Moldavian president now. So, here are some of the phrases that I would like to comment.

“…whether the President was acting within his constitutional power when he issued an order directing the Secretary of Commerce to take possession…” – well, in the Moldavian constitution there’s the third title, which stipulates clearly the duties of the president. But the constitution of United States consists of 30 amendments, which definitely can’t explain everything.

“… Acting within the aggregate of the Commander in Chief of the Armed Force…” – our president won’t be the Commander in Chief, because it’s just not his duty. I consider in this situation the Parliament will take act.

“… the constitution limits his functions in the lawmaking process to the recommending of laws he thinks wise and the vetoing of laws he thinks bad…” – from these words I understand that the constitution of United States, normally limits the activity of the president, just to a sort of legislative duties. He has to follow the process of adopting laws. The Moldavian president has also a legislative duty, in a way. When the law is adopted by the Parliament, the President should put his signature on it, or send it back to the Parliament, to revise it.

The institution of a president is considered to belong to the executive branch. As Moldova is a parliamentary republic, the duties of the president are very limited. He just has the representative role on the international arena. I don’t think that in case of a war, our president will be the commander in Chief of the Armed Forces. Our president can make orders, but they are often purely individual orders. He can’t adopt laws, and he is totally under the control and the domination of the Parliament. So, the Executive Order 10340, would never happen in the Republic of Moldova.

About the corruption in Moldova

Corruption in our country has reached such sizes, that directly threatens national safety of the country. At existing orders when all country lives one day and it is obvious not on means, extracting money all accessible and not always in the faultless ways, bribes will take and give. And all to us need only - to compete one: to officials - who has more taken, - who has less given citizens.

But still many journalists consider this a change of political mood of Russia, and they are not sure weather the pesticides could be taken out of Moldavian wine, which also served as a pretext for interdictions.

Besides fixed telephone services, it provides also internet services, and also cheap VOiP. Moldtelecom represents the monopolist company in Moldova and the state protects its activity, doesn’t let other operators to activate in Moldova, like it is in other countries. Chisinau authorities do whatever they want with the public property

On NIT has just said about the reconstruction of the biggest park in Chisinau. Vasile Ursu, which is the executor of duties of the Chisinau mayor (also the representative of the communist party), has told that on a place of the huge lake, situated in Valea Morilor park, an entertaining complex will be constructed: an aqua park, a parking place, a hotel, different bars, restaurants, and all kind of distractive places. Also the president of the Republic of Moldova, Vladimir Voronin, had added that – it is necessary to allow constructing to all wishing investors in the park, and finally transform it in pleasant vacation spot, (even though it was one of the favourite place of Chisinau citizens, and they really enjoyed its natural state).

This summer, this lake suffered some very strange actions. One morning the people had to become witnesses to an ecological catastrophe. All the fish in the lake had died and emerged. The horror of this scene was increased by the awful smell of the dead fish. There where many versions about this event. But the public authorities, as the main version consider the high temperature which exhausted the fish and caused its death. Even though there was another version, that the fish was murdered purposely, for certain reasons.

After this declaration on TV, about the construction of an entertaining center, the last version seems to be very real. The public authorities hide many facts for sure.

Integrated History texts will be examined by Academy of Sciences commission

A commission formed of 35 doctors of history, academicians, habilitated doctors, correspondent members of the Academy of Sciences of Moldova (ASM) and scientific researchers will analyze the integrated history textbooks used in schools in Moldova.According to the ASM’s press service, the commission members were designated by the Supreme Council for Science and Technological Development as a result of a working meeting between decision makers and at the request of the Institute of History, State and Law of the ASM.

The persons that want to take part in the examination of the texts should apply to the mentioned commission. The experts will present their reports by December 25 after which a commission will forward specialists’ recommendations to the Ministry of Education and Youth.

Integrated history represents the history of the part of the moldavian province, which is called Basarabia, today's Republic of Moldova. Many historians, teachers and proffessores were very frustrated by the introducing of this integrated history. They consider it an invented one. There are many facts that are changed in it, on a certain purpose. The notion of integrated history is considered to be a political invention, in order to try to represent that Moldova had been historically separated from Romania, which is evidently wrong.

Saddam Hussein sentenced to death by hanging

Saddam Hussein is sentenced to a death penalty through hanging, for the main reason, crimes against humanity, including its totalitarian character. The court has recognized also guilty on business about massacre and has sentenced to life imprisonment of former vice-president of Iraq Taha Yasin Ramadana.
According to Saddam’s opinion, this punishment is humiliating. As a military criminal he considers a bullet more correctly in this situation.
The reasons of this sanction are surely political first of all. American republicans are being blamed for the Iraq war, and this verdict could serve as an advantage for them, on the intermediate congressional elections, which will take place on the next day.
The legal procedure on Saddam took place more than a year. The case was investigated by 5 judges, which were replacing one another for several reasons. The 3 lawyers of Saddam Hussein were killed.

Even though the verdict seems to be very cruel, some political analysts consider that Saddam could be amnestied.

Chisinau declares Moldova's Customs Service fully controls export from Transnistria

The Ministry of Reintegration says the Customs Service of the Republic of Moldova has full control over the export from the Transnistrian region. At the same time, the Moldovan customs agencies control only 10% of the imports into Transnistria.

According to the Ministry of Reintegration, the establishment of full control over exports is due to the protocol on the border crossing regime for goods signed by the customs services of Moldova and Ukraine on May 15, 2003.

By November 1, the State Registration Chamber of Moldova has registered 248 Transnistrian economic operators, including 135 on a temporary basis and 113 on a permanent basis.

The goods exported and imported by the Transnistrian businesses, which were checked by Moldova's Customs Service between March 1 - November 1, 2006, totaled over 3.642 billion lei, including over 3.98 billion lei exports and 543,913 million lei imports. Metal products account for over 74% of the exports.

On November 1, the Government extended the decision No.1001 of September 19, 2001 regarding the declaration of goods by the Transnistrian economic agents until January 1, 2008./

has finished the building of the international Giurgiulesti terminal on the Danube River. Now it can accept the sea vessels from anywhere. The president of Moldova declared that this is a very important economical, social and political event, which could lead to new international relations, to the touristy development, and to new working vacancies for our people.

The first sea vessels will arrive by the end of 2006. It has mooring for bulk-oil tankers, 8 tanks for storage of mineral oil by the general capacity of 52 thousand tons. The terminal is equipped by modern system of a storm drain and clearing of residual waters, and also waters with the maintenance of oil, the substation automated by system of fire protection.

Construction Giurgiulesti of the international terminal proceeded 10 years with breaks because of difficulties with financing the project in cost almost 30 million dollars. The Azerbaijan company Danube Logistics SRL known earlier as Azertrans SRL was engaged in realization of the project.

Why Transnistria has no right of being independent.

The Soviet socialist Autonomic Moldavian Republic was formed in 1940, with the initiative of a local group, headed by Kotovsky. So, as you see, this wasn’t the will of the population. No elections, no referendum took place. This was the action of a small group of people, which wanted to promote their own interests, and of course by support of the USSR. In conclusion, Transnistria was taken illegally from Basarabia, without its accordance. Can they now ask for independence, basing on the fact, that they used to be separated illegally? Of course – not! The population of Transnistria was formed by Romanians (Moldavians), and it was violently assimilated with Ukrainians and Russians brought from abroad.

Even nowadays, the considerable part of population of Transnistria consists of Moldavians, more than 40 %. They represent the native population.

No region can ask for independence whether it consists of the same people as the rest of the country. Only an entire nation can ask for independence. Transnistria doesn’t represent that case. These are the same people that live on the territory of the Republic of Moldova. Here, we also have Russians, Ukrainians, Bulgarians, Turks, Jews, etc. But they represent an ethnic group, same as the Russians and Ukrainians in Transnistria.

The political authority has an illegal existence in Transistria. There were no states that recognized the independence of Transistria in the early 90’s. You can’t be independent if no one recognizes it.

About the referendum that took place in September, 2006, there’s an opinion of the head of the OSCE mission in Moldova:

“The OSCE will not recognize this referendum, and we have no intention to support or observe a unilateral action, which calls into question the territorial integrity and sovereignty of the Republic of Moldova...”. The international observers, often are not let in on the territory of Transnistria, especially at elections. This demonstrates the non-democratic character of the Transnistrian so called “government”, and their political behaviour.

The referendum was against the constitution of the Republic of Moldova. Because it represent a unitary state, not a federation, that’s why no region can ask for independence, especially if the interest of other countries are involved.

Passive strike in Chisinau, on the 29-th of October 2006

There was formed a special committee to sustain the declaration of the Romanian president Traian Basescu, about the integration of the Republic of Moldova in the European Community together with Romania, at 01.01.2007.

According to the Infotag Agency source, as the president of this Committee was chosen a university professor Vasile Ursu, as vice president – Ilie Bratu (the president of the unification movement from Moldova), Nicolae Dabija (the president of the democratic Romanians from Moldova, the president of the Romanian union from Basarabia), Dionisie Gutu (the president of the national Romanian party).

The committee considers that the slogans of the authorities from Chisinau, about the integration of the Republic of Moldova in the European Community by itself as an independent state, represent simple speculations, with the purpose of confusing the electors and the international public opinion. “The integration of the Republic of Moldova in the European Community is possible only in case when this territory will become an integrate part of the United Romanian State.”

This committee intends to organize a passive strike, on the 29-th of October, on the Big National Square, to sustain the initiative of the Romanian President, Traian Basescu.

In case of the opposing of the authorities, to agree to this statement, they promise to organize massive strikes and movement, according to the legislation.

Russia breaks the sovereignty of the Republic of Moldova

As it is mentioned in its constitution, the Republic of Moldova is a sovereign, independent state. So this means that it is independent in solving all sorts of problems, including internal and external problems. So economical reforms, for example, administrative or constitutional, whatever it can be, Moldova has the right to resolve them by itself, as well as the international traits. After the disintegration of the USSR,

gained the right to be independent in all its activities. But Russia doesn’t consider so. Not looking at different international agreements, Russia stills keeps it munitions on the territory of Transnistria, which is a territorial part of Moldova. Russian Federation promised many times that it will take the munitions, but yet they didn’t do that. They use to call it “Peacemakers” - which is definitely not the perfect identification of their activity there. Because as the Transistria’s government is located illegal there, the same thing Russian military bases do. They are situated there against the agreement of the Government of the Republic of Moldova and of any other states.

In conclusion: Russia kept its aggressive and dominative character, especially against the states that she used to dominate some time ago.

Republic of Moldova – is or not a State of Law

Trying to analyze whether Moldova is or not a state of law, by its entire criterion, you can get a doubtful opinion.

The first article, point 3, of its Constitution, sustains that the Republic of Moldova is a state of law: “the Republic of Moldova is a state of law, democratic, where the human dignity, the human rights and liberties, the free development of the personality, the right and the political pluralism represent the guaranteed supreme values.”

This article really counts all this criterions of a state of law. But the real political and social life differs from what is written in the constitution.

As I mentioned earlier, only a democratic country can pretend to be a state of law. Moldova is being democratic only for 15 years. Our democracy is very young and brittle. Our government doesn’t have that mush experience, to be able to pronounce that law is the supreme power in this state. We are under a huge black spot for being a part of the USSR. This had a total opposite political regime from a state of law. And after the break up from USSR, the Republic of Moldova was trying to redirect its political orientation.

By the form of Government, the Republic of Moldova is a state of law. Is has the separation of powers. By the way it is a parliamentary republic, which is even more democratically than the presidential republic. The population secretly votes the Parliament. The legal procedure of elections is supervised by the international supervisors.

Another characteristic of a state of law, is the Supremacy of Constitution. The Republic of Moldova also respects this. No legal norm can be applied if it is contrary to the Constitution.

By all this steps Moldova seems to be a state of law. But, somehow, the biggest problem is the violation of human right. It exists anyway, not by laws, but by the disorder, by no control of the society and the political authorities. First of all it’s the judicial organs. There were many cases, when Moldovan Supreme Court was giving the person a verdict, which was violating his rights. And after the appealing to the European Supreme Court, the Republic of Moldova, for many times was receiving punishments from it (had to pay certain sums of money to the plaintiffs, and had to agree that they activated against the human rights).

In conclusion: Moldova is formally a State of Law,. Even though it is written in the Constitution so, in many situations it doesn’t reflect the real situation, because of the corruption of the political and judicial authorities, because of not having any democratic experience. So, the Republic of Moldova has to evolve a long period of time, to perfect not only its legislative domain, but also its executive power. Constitution should be an active document. As the basis of all the activities, should serve the human rights not only formally, but in fact.

State of law is an institutional form of political organization of society, which has as the main aim the protection and promotion of the basic human rights and liberties. State of law is not a state where the laws are respected, but it is a state where the human rights serve as the primordial values for the whole government, for population and for the social ideas.

The characteristics of a State of Law:
Normally, the first characteristic is the level of democratization of the state. A totalitarian state cannot be a State of law. It can be determined by the electuary fact – how the election procedure takes place. If the whole population, that reached the age 18, has the right to vote the Parliament, to vote secretly and by his own will. The population should have the right to change their representatives in the Parliament, the governors, anytime they want it.
By its form of government – a State of Law is based on the principle of the separation of the state powers. This principle guarantees a real independence of the justice. Each political, institutional authority should have its own domain of influence. A contrary example can serve the USSR, or other totalitarian states which denied this principle.
The supremacy of Constitution, which is based on the fundamental human rights, and liberties, which everyone should obey, and no other juridical norm, no governor can conquer it.
Equal rights and chances to everyone. A State of Law is a social state anyway, which protects the rights of every human, no matter of his age, sex, nationality, religion, social status etc.

In conclusion, a State of Law is, first of all, a democratically governed state.
